REQUEST FOR RESPONSE TO WATER RIGHT COMPLAINT REGARDING DIVERSION FROM THE WESTSIDE GROUNDWATER BASIN IN THE COUNTIES OF SAN MATEO AND SAN FRANCISCO

By letter dated July 23, 2001, I asked the respondents to this complaint to submit formal resonses.  However, I recently received aletter from richard Roos-Collins representing California Trout, Inc. (copy enclosed) asking that this request be withdrawn as San Francisco, Daly City, and three of the respondent golf courses have offered to add California Trout, Inc. to their onging mediated negotiations.  These negotiations are intended to resolve the key issues that led to the complaint.  Mr. Roos-Collins believes that there is a possibility that other stakeholders may also be allowed to participate in thse negotiations.  Consequently, responses to the Cal Trout, Inc. complaint will not be necessary at this time.

I understand that Cal Trout, Inc. is not withdrawing the complaint at this time.  Instead, Mr. Roos-Collins has requested that the parties in negotiation be directed to file quarterly reports regarding their progress with the Divison of Water Rights (Division).  I am asking Mr. Roos-Collins to coordinate the submittal of these reports assuming such action is acceptable to the negotiating parties.

Unless someone objects, I will change the status of this complaint to"inactive" and the Divison will take no further action in this matter until such time as Cal Trout, Inc. requests that the complaint be reactivated or withdrawn and closed.
